Judge orders woman to stay out of Norwalk

A former Norwalk woman accused of possessing two drugs will be staying with her bondswoman in Toledo while she remains out on a $10,000 bond.

The woman overseeing Nicole J. Fertig's bond called the defendant "a friend of the family" at Monday's arraignment.

"I've known her since she was 3 years old," the Toledo woman said.

Huron County Prosecutor Russell Leffler had requested the judge revoke Fertig's bond in connection with testing positive for "numerous controlled substances."

"I will take control of Nicole. I have no problem with it," said the bondswoman, who had brought Fertig to the courthouse Monday.

About the drug tests, the bondswoman and Huron County Public Defender David Longo said Fertig "used heroin right before she went to jail," so it's possible some of the drug was still in Fertig's system at the time of Monday's drug screen with a probation officer.

Fertig, 23, was indicted Friday by a Huron County grand jury, charged with one count each of possession of heroin and possession of methadone. Leffler said the Norwalk Police Department received a call May 22 from Mickey Mart about two women who had been in the restroom "for a good long time" and officers determined one of them had been shooting up heroin. Fertig's Huron County Common Pleas Court trial date is Oct. 17.

Fertig appeared in court Monday -- two weeks before her scheduled arraignment.

"She was here on a summons. She is here on less than a summons. She wasn't served before she appeared (in court)," Longo said.

"She's been staying with her bondsman in Toledo to stay away from her old cronies," he added.

Judge Jim Conway, at the state's request, prohibited Fertig from being in the Norwalk city limits except for court hearings, probation office visits and random drug screens. The judge said the drug tests would be done "a minimum of one time per week."

The bondswoman started to protest Leffler's request about staying out of Norwalk, but Fertig quickly agreed to the added condition of her bond.

"That's fine," the defendant said.

In late October, Fertig made local news when she was charged with public indecency after several witnesses reported seeing her and a now 38-year-old man having sex in a white GMC truck at the Bob Evans parking lot on Milan Avenue.

For that incident, Fertig was convicted of disorderly conduct Feb. 20 in Norwalk Municipal Court. She was fined $200 and given a 30-day suspended jail sentence. Fertig is prohibited from entering the Bob Evans property during her two years of probation.

Fertig also is banned from Walmart for two years, following a Feb. 4 theft conviction that resulted in a 20-day jail term and $360 in fines and court costs.

Fertig and Eddie Blair, a 36-year-old Spring Street man, were caught shoplifting at the Westwind Drive store in late January, police said.

Blair, incidentally, also was indicted Friday by a Huron County grand jury. Blair is charged with two counts of trafficking in heroin. He was secretly indicted, so the charges weren't made known until after his arrest.

...you never get your young life back... hope the bondswoman can make a difference in this young person's life and give her a shot at turning it around... its never too late to clip your baggage, let it slip into the wake and sail on...

Bath house? Get a grip people. This is addiction at it worst..she needs a safe house...treatment, and a committment to get well. The will to heal. This is no life, actually it is death except you're still breathing. Hope she grows, gets the help she needs, and becomes the person that she really can be!


I agree with you concerning this young lady's dire circumstances, however, the comments section is hardly the place to expect sympathy. it's a jungle on here. the only way to avoid scrutiny is to stay out of the news


IM not saying haveing sex is smart thing do in public place but i think theres lot worse things been done. I hope she can get clean seems be a pretty young lady whose just made some bd decisions in life.

You know I really don't get people on here. Any other time, the comments whenever it's concerning an addict you people want to pretty much tar and feather them, B**** that they're in and out of jail and they only get their hand slapped! Why is this one any different? Cuz she's young and pretty? Don't get me wrong- I believe in second chances and thirds, if need be- but I really don't get it? This young woman was having sex in the parking lot of a FAMILY restaurant in plain sight for others to see! WTF/ And now she's testing positive at her P.O.s visits!? The parking lot thing pi**es me the eff off! I was pi**e when she was caught- I take my kids there a couple of times a month. God help her young a** if I would've saw her! She's just as bad as any of the others we see on here day in and day out- she's playing the system cuz she knows if she doesn't have a prior felony, there's nothing the court can do but sentence her to county time.


You're exactly right, I feel the same way! This isn't the first time she's been in trouble....she knows just what she's doing!!! Good luck to the bondsman, they should've atleast left her in jail long enough to get clean!!

I agree with the need to stay away from the "cronies", I preach to a friend the same thing. I really have a problem though with the order to stay out of the city I.E an "order",I understand businesses, residences and people, But how, in a supposed "free" land this is possible? The fears of the mind decrease the liberty you have. I am not in support of her,dont get me wrong. I have a question then,all the junkies and dealers being slapped on the wrist and released after snitchin out,why are they not "banned" from the city....?


Agree with this is supposed to be the land of the free. We are losing more rights every day. However, we're talking of people that CHOSE to give up certain rights by breaking laws.

Sure hope the bondsperson has an extensive knowledge of addiction. An addict will use any means of minipulation THEY can. That being said, good for the judge to tell her to stay out of town. Too bad that isn't told to every one convicted. But where does everyone expect them to go? Mandated programs like CBCF aren't working. Seems they are allowing people in that go right back to the same old crap. What's the answer???


First - Niki's already been to prison once so Judge Conway can send her there if he deems it appropriate.
Second - Saramac: heroin addiction is a pandemic both here and most everywhere else in this country right now. The system is criminalizing a generation to try to fix this and it simply is not working. All that is being accomplished is clogging the prisons and jails with drug addicts instead of the violent people who need to be there.


I learned about drugs from DARE...anybody else agree with me here?
