Drug defendant fined, gets no jail time

A Greenwich man was fined $500 Monday for possessing THC.

Paul J. Duncan, 24, of 30 Senior Drive, has 60 days of discretionary time in the Huron County Jail hanging over his head during his three years of probation. Huron County Common Pleas Judge Jim Conway warned the defendant that his probation officer "can schedule as they see fit" or ask to have the term waived if he does extremely well on probation.

Duncan, who declined to speak on his own behalf during last week's hearing, had his driver's license suspended for six months. The judge granted him driving privileges for work, treatment and schooling if Duncan chooses to pursue his GED.

In late April, Duncan pleaded guilty to possession of THC (Tetrahydrocannabinol). The conviction is for a June 29, 2012 traffic stop by the state Highway Patrol.

Defense attorney John Kirwan said his client has nearly completed a substance abuse treatment program at Firelands Counseling & Recovery Services.

Since Duncan "is doing well," Huron County Assistant Prosecutor Richard Woodruff said the state wouldn't oppose community control sanctions and "some discretionary jail time."

This was Duncan's first felony conviction and because he pleaded guilty to a fourth-degree felony, he wasn't eligible to be sentenced to prison. If he violates his probation, he faces 18 months in prison.

This guy gets more for THC-or "T"- than the heroin heads get for killing our kids! Are they scared he's going to make off with the whole batch of New Twinkies when he gets the munchies late night? What a joke. Our court system is pathetic. I hope this doesn't ruin him for life. Should have done coke, heroin, ecstasy, LSD or pills. Would have gotten less. Go for a trip next time..more fun and less BS.
