Man kicked out of CBCF but avoids prison time

Food stamp violator who is a 'severe heroin addict' is sent to different substance abuse program; judge imposes no further jail time because defendant is back to work.

A man convicted of misusing food stamps who violated his probation was ordered to complete a Volunteers of America (VOA) substance abuse treatment center.

Former New London resident Donald S. Adams Jr., 27, will remain in the Huron County Jail until his transported to the VOA facility.

"I am a severe heroin addict," Adams said in court Monday. "I can't get a handle on it myself."

Adams was kicked out of a community-based corrections facility (CBCF) Dec. 15. Defendants spend four to six months in a CBCF, a locked-down facility that focuses on substance abuse treatment and education. This was second probation violation since being placed on three years of intensive probation Oct. 9.

On a second violation, the state usually requests a prison term, Huron County Assistant Prosecutor Daivia Kasper said, but she recommended Adams continue on probation and complete the VOA program.

In October, Huron County Common Pleas Judge Jim Conway imposed no further jail time because Adams had gotten a roofing job back.

However, Adams was ordered to pay $891 in restitution to the female victim for the food stamps, debit card and cash she lost. The court also ordered him to work toward his GED and maintain a job.

In late August, Adams pleaded guilty to one count of illegal use of food stamps. Prosecutors, as part of a plea deal, agreed to dismiss three similar charges.

Adams used the woman's food stamp card, similar to a debit card, in New London and at least once in Ashland County, a prosecutor said. Each of the four transactions in early January 2012 was worth less than $1,000.

Before being sentenced in October, Adams finished serving a one-year prison term at the Lorain Correctional Institution for a series of local probation violations, which included testing positive for opiates. His original conviction in July 2008 was attempted failure to register as a sex offender.

I'm all about second chances, but 3 or 4? Just another example of Czar Conway pickin and chosen who he wants to punish. The pubic needs to wake up and bring this to Columbus's attention. This man should have never been elected judge.

You're wasting your time. Just wrote this a few min ago on another article, but y'all can write to the Disciplinary Council until your fingers bleed. You can't get rid of a judge by accusing him of being lenient...EXCEPT AT THE POLLS. And y'all just re-elected him, BTW.

The next time Conway runs is 2018. The next time Leffler has to run is 2016. Sounds like they're both going to be around for a while.

Actually he ran unopposed, so one person in the county could have voted for him and he'd have been back in. If you check the numbers, over half of the people who voted in that election left the box next to his name blank...as I did.
