Victim: 'He took advantage of me'

The sexual battery victim sounded distraught and was hard to understand when she called her father after reportedly being raped.

The 18-year-old woman's father testified Wednesday in Huron County Common Pleas Court. He received a call from his daughter, who was using her best friend's cell phone, at 3:25 a.m. Dec. 29, 2010. His daughter had been playing Beer Pong with her best friend, the suspect, Cory N. Puder, and Puder's best friend.

Puder, 23, of 941 Jarvis Road, Wakeman, is charged with two counts of sexual battery in connection with sexually assaulting the 18-year-old college student who had been drinking. Puder, a Marine, was on leave and the victim was home during Christmas break.

Some time after the victim took the stand, Huron County Prosecutor Russell Leffler requested she identify Puder. Tears welled up in her eyes as she refused to look toward the defendant.

After a lengthy pause, Leffler asked the victim if she would say what Puder was wearing.

She didn't turn her head. Crying, she very quickly glanced to the other side of the courtroom, looked back at the prosecutor and said Puder was wearing a purple shirt.

The father told Leffler about how his daughter sounded during the phone call.

"She was sobbing, almost uncontrollably. (It was) almost hard to understand her," the father said.

His daughter then told him she'd been raped.

The victim, now 19, told her friend a similar story. The victim said she fell asleep on a couch in the living room while the group played Beer Pong in the kitchen because she didn't want to drink any more.

"I was tired of drinking. ... I just couldn't drink anymore," she said.

When Leffler asked her what she remembered happening next, she recalled hearing Puder saying her name "vaguely," but she was concentrating more on sleeping.

Next, she said she woke up on her back next to the couch with her pants and underpants pulled down.

"He was over me. ... His pants were pulled down," the victim said.

"I yelled, 'What are you doing?,'" she said. "He jumped back like he was shot."

Puder leaned toward her to pull her pants back up, she said, but she told him not to touch her.

"He pulled my underwear up for me and I told him to get away," she said.

A few minutes later, she walked to the room where her best friend and her boyfriend -- also Puder's best friend -- were, but she said she didn't completely pull her pants for some reason.

"My pants were halfway down my thighs," the victim said.

"I was asleep. He took advantage of me. I don't know if that's coercing," the victim told Puder's attorney, Ed Rhode. "It was something you don't forget."

The victim's best friend also testified Wednesday.

She said her friend came into the room where she and her boyfriend were after the incident.

"Her pants were down. ... She was crying," said the victim's best friend, who also testified that her friend's zipper and belt buckle were undone.

The friend said she tried to get the victim to talk about what happened, but she wouldn't talk much until the boyfriend left the room to talk to Puder.

"I asked her if she was raped and she said, 'Yes,'" the friend said.

She said she later heard her boyfriend tell Puder "it was better that he leave." The friend also said she saw Puder fully clothed after the alleged incident and didn't see any scratches on her friend's face.

While waiting for the victim's father to arrive, the friend said she and her boyfriend didn't press the victim for details, but tried to console her.

Huron County Sheriff's Lt. Annette McLaughlin, who is now retired, testified Tuesday that Puder wasn't at the apartment building when she arrived about 3:45 a.m. The victim's father had arrived 10 to 20 minutes after his daughter called. He called the sheriff's office soon after he got there.

"She had an odor of alcohol about her body," the father said, adding that his daughter seemed to be intoxicated.

At the direction of McLaughlin, the father took his daughter to Fisher-Titus Medical Center so she could be evaluated. Because no sexual assault nurse examiner (aka SANE nurse) was available, the father took his daughter to Firelands Regional Medical Center in Sandusky.

"I didn't see any injuries," said SANE nurse Lisa Haley. "Her hair was well kept."

The victim's friend and crime scene investigators said they didn't see any signs of a struggle in the living room where the couch was. The friend and victim said there had been no flirting with Puder before the incident.

One or two more state's witnesses might testify today.

The part that keeps sticking in my head is: She fell asleep on the couch, but woke up next to the couch on her back. How did she get from point A to point B and not have any knowlege of it? It just screams "black out" to me. And if she can't recall that...perhaps there are other things she can't recall. I can't imagine being so drunk I don't feel someone picking me up, and then taking my pants down!?!??! Not making sense to me.

well im not her, but if somebody was pullin my pants down i would wake up whether i was drunk or not, and i dont think i've ever had to "concentrate on sleeping" when i was drunk or sober...and how come she isnt being charged with under age consumption??...sad. good luck puder, my thoughts and prayers are with you!

I for 1 said several times I don't blame her. and I personally went through a similar situation as I stated before. and to be honest if my family member was in the paper I would suggest not reading the blogs they're not very nice. they're not nice anywhere. if you read the wiki rules for blogging it tells you to ignore the trolls...... just a thought no need for a response

Wouldn't you find the order of things more appropriate to wake her up and ask her first? No! not me.. But must say i am glad i am not a teen nowadays. Too much drama, girl loses virginity, she thinks it's the greatest thing. In LOVE. TILL..... realizes the guy she met actually is her arch enemies boyfriend or he dumps her few days later,etc. and she got used or like this case party and then "oh my how can i get out of this one"?. Sorry. Parents used to just talk about life lesson's with there kids, and have the chick take some responsibility. How can you be charged when you assumed you were committing no crime and when you found out you back off "like being shot" I see an acquittal coming. There appeared to be no criminal intent. I assume he was offered a plea bargain which he rightly refused.

Personally, I am wondering if the concentrating on sleeping part was taken out of context. I believe the three were still playing pong when she heard her name mentioned, most likely after she had just layed down. I am willing to bet the incident happened a while later after she was sleeping. I don't think you can take much from the incident the way it is reported in the paper. Makes you wonder about the blacking out part though.

Then, when you yell STOP... he stands up and pulls his pants up? I'd call that just short of being raped or attempted rape. This girl, it seems, removed herself from the partying...she quit, knew she'd had enough and went to sleep it off. It's not like she was still in the game and started messing around with this boy and let things get too far...then the next day changed her mind because daddy might find out. Sounds to me like this boy knew his buddy was having some fun in the next room with his GIRLFRIEND, and thought it only right that he should have some fun also...without asking.

But I do believe he had every intention of having sex with the girl...had she not woken up. He thought this was an OK thing to do to a girl who was asleep on the couch. It doesn't matter HOW asleep she was, she removed herself from the partying to go to sleep. Read the story again...his buddy and girlfriend were in the other room doing their own thing at the time this happened. She got up and went into the room they were in to get them with her pants still undone. He figured if his buddy was getting some, so was he. He attempted to take without asking. I do agree with you, young adults, especially girls should never put themselves in a position of drinking to a point where they cannot control a situation. I do not blame her for this either, but girls need to realize they put themselves in unsafe positions when they cannot physically and mentally control a situation due to alcohol. She was lucky, he stopped.
