A prosecutor has declined to file charges against a teenage boy who came to the aid of his mother, an attempted rape victim.

"It's a pending investigation. I've received reports, recordings and other documentation and based on my review of the evidence at this time, I have decided not to file delinquency charges against the juvenile," Huron County Assistant Prosecutor Jennifer DeLand said Monday.

The attempted rape happened at a rural Wakeman home in the early morning hours of Jan. 25. A dispatcher with the Huron County Sheriff's Office received a 9-1-1 call at 3:43 a.m. -- an emergency call that lasted about 15 minutes with no one picking up the other line.

Nathan L. Hindle, 31, of 4674 Wenz Road, Wakeman, was arrested Jan. 30 in Norwalk on an attempted rape warrant. If convicted of the second-degree felony, Hindle faces two to eight years in prison and a maximum fine of $15,000.

DeLand declined to go into the specifics of the case.

Capt. Ted Patrick has said the victim's 14-year-old son came to his mother's aid and tried to non-violently intervene, but when that didn't work, he picked up a 6-inch knife and stabbed Hindle three times in the back. Published reports indicate that Hindle, the woman's boyfriend of 12 years, is accused of taking the 33-year-old woman to the ground in the living room, choking her and ripping her clothes.

"He was simply going to the defense of his mother and trying to intervene without any weapon and that didn't work," Patrick said soon after Hindle was arrested.

An ambulance transported Hindle to Fisher-Titus Medical Center, where he was treated and later released.

When the 9-1-1 call came in, there was nobody on the other end of the line, but a man, believed to be Hindle, is heard cursing.

"Hello? Do you need an ambulance?," the dispatcher asked. "Do you need an officer?"

About 3 1/2 minutes into the call, the dispatcher told a deputy it sounded as if Hindle was "advising a female she's not nice to him and (doesn't) take care of him." About one minute later, the dispatcher said the two people's "voices are raised now."

"She's yelling for him to stop," the dispatcher said later, referring to the victim. "She's advising for him to get off her."

By the fifth time the woman is heard telling Hindle to "stop," she says it much louder and seems to be screaming. Each time, the man identified as Hindle said: "Or what?"

It's unknown what caused the argument.

Hindle remains in custody at the Huron County Jail, unable to post a $50,000 bond.

He's prohibited from having direct or indirect association or communication with the victim or anyone under the age of 18 if he posts bail.
