House OKs bills that would give Ohio the country's most restrictive anti-abortion law

The Republican-controlled House of Representatives today passed a series of bills that would give Ohio the most restrictive anti-abortion law in the country.
Dubbed "the heartbeat bill," House Bill 125 by Rep. Lynn R. Wachtmann (R-Napoleon), would outlaw abortions after a fetal heartbeat can be detected, generally six to seven weeks into pregnancy. It passed by a 54-43 vote.
"If we can detect the heartbeat inside a pregnant woman, we know for certain that the heartbeat is from a life within the mother, said Rep. Terry Boose (R-Norwalk Township) after he and fellow representatives OK'd the bill. "The most basic function of government is to protect people's right to life, liberty, and property. By passing this bill we finally will be able to more successfully protect these rights for the unborn."
This legislation also would prohibit individuals from performing an abortion on a pregnant woman prior to testing whether the child she is carrying possesses a detectable heartbeat. If a heartbeat is detected according to standard medical practice, an abortion will be prohibited by law unless the pregnancy threatens the life of the mother.
"This is a historic vote," said Janet Folger Porter, the former legislative director for Ohio Right to Life who led efforts to pass the legislation. "When passed, the heartbeat bill will be the most protective legislation in the nation."
Abortion-rights groups say such a law would effectively ban abortions because most women don't know they are pregnant that early.
"It's obviously an undue burden if you can't have an abortion even before you know you are pregnant," said Kellie Copeland, executive director of NARAL Ohio.
The legislation has raised concerns from both sides of the abortion debate, including Ohio Right to Life -- which has cautioned lawmakers that such a law is likely to be found unconstitutional because it would be too restrictive under current law.
The the U.S. Supreme Court established a woman's right to an abortion in its landmark 1973 Roe v. Wade ruling, which forbids states from banning abortions until a fetus is viable, generally about 24 weeks into pregnancy.
Two other anti-abortion bills also were approved in the House on Monday: House Bill 78, a more-limited abortion ban that would outlaw post-viability procedures, and House Bill 79, which would prohibit insurance plans from covering abortions in the health-insurance exchange that Ohio will create as part of the federal health-care reform.
House Bill 78 would prohibit an abortion if the unborn child is confirmed to be viable, which is possible by about 22 to 24 weeks. If a child is considered viable, an abortion is prohibited except in the case of a medical emergency or if the woman has a serious physical health condition. In cases in which an abortion is medically necessary, the procedure must be performed at a neonatal facility where the method is most likely to permit the child to survive.
House Bill 79 would prohibit the coverage of elective abortions within the health plans required by the new federal health care law. The federal law requires each state to establish an "American Health Benefit Exchange" to encourage the purchase of health care plans, which may include elected abortions as a health care benefit. However, a state may prohibit abortion coverage in its own health benefit exchange if the state passes a law specifying as such.
"I do not want taxpayers' money to be used to fund abortion because it violates the conscience of many Ohio taxpayers who oppose abortion," Boose said.
Michael Gonidakis, executive director of Ohio Right to Life, said the post-viability ban is part of a national effort to topple Roe v. Wade.
Ohio is poised to become the seventh state to enact a law prohibiting abortions after 20 weeks if a doctor determines that the fetus could survive outside the womb. Similar bills have been introduced in about 16 other states.
Abortion-rights advocates say such laws are unconstitutional, but there has been no court challenge so far.
Although the fetal heartbeat and post-viability bills would set different restrictions on abortions, House Speaker William G. Batchelder, R-Medina, has said that, after consulting with legal experts, he thinks there is no issue with passing both bills at the same time.
In addition to these three anti-abortion bills, House Bill 153, the state budget proposal that will be sent to Gov. John Kasich this week, includes a provision banning publicly funded hospitals and clinics from performing abortions.
"This is supposed to be budget week," Copeland said. "If you count what is still in the budget, they plan to pass four serious restrictions on abortion, all posing significant and substantial dangers for women's health."
House Bills 78, 79 and 125 will now move to the Ohio Senate for further consideration.

I am glad for legislature having consideration of and for Life and the unborn children, with regard to Ohio House Bills #125 & 78. Bill 125 would prohibit the procedure if a heartbeat is detected. Bill 78 would block abortions at 20 weeks after conception. With regard to Life, two passages of God's Word, from the Holy Scriptures come to mind as follows: Psalm 139 -13 For you created my inmost being; you knit me together in my mother’s womb. 14 I praise you because I am fearfully and wonderfully made; your works are wonderful, I know that full well. 15 My frame was not hidden from you when I was made in the secret place. When I was woven together in the depths of the earth, 16 your eyes saw my unformed body. All the days ordained for me were written in your book before one of them came to be. 17 How precious to me are your thoughts, O God! How vast is the sum of them! 18 Were I to count them, they would outnumber the grains of sand. As you can see, these words are for the unborn, as well as for You and Your loved Ones, and Everyone made by our Creator in His image and likeness. The 2nd Scripture that comes to mind is from Proverbs 31: 8 “Speak up for those who cannot speak for themselves, for the rights of all who are destitute. 9 Speak up and judge fairly; defend the rights of the poor and needy.” On behalf of those who cannot speak for themselves, to our Legislative Officials, I want to say thank You and that You have my support for Your affirmative response in issuing forth these Life preserving Bills. Why struggle so hard to protect unborn babies, I wonder? Could it be because people are naturally drawn to things which tug at their heart strings? Lemme ask ya. When 1,000,000 Iraqis were killed in our quest to dominate the middle east, where were all the "late term" abortion critics THEN? How many thousands of Afghani citizens were killed in our quest to secure opium rights there? No "abortion critics" heard THERE either. How about our children-killing mindless drone attacks in Pakistan? Anybody object to that? How about Somalia? Libya? Have any ONE of the people that are "anti abortion" considered for one second the millions of "late term abortions" war causes? It's wonderful to champion the cause of children. But understand 2 things.1: Children are the first thing politicians hide behind when they're trying to pass laws to take your freedom and civil liberties away.

People tend you look at you like a kook if you don't support blowing up brown people for their resources and when they won't play ball with the IMF.
Not everyone has that type of courage, do they? People tend to pick the easy fight.
We won't even DISCUSS how a huge portion of abortions occur because women don't want to interrupt their careers, that would be tantamount to an attack on feminism. That's another bag we don't want to pick up and handle isn't it?
Or how the rest of them are economic in nature, we don't want to discuss how our system has put so many into poverty that abortion is the only thing that makes sense.
It's much easier to wave a "I protect babies!" flag, I guess.

Sadly not all the unborn are defective. Too often it is a matter of convienence for the mother. To compare abortion and the death penalty, innocent unborn babies not given the chance, to adults who have been given the chance and chose to comitt crimes, This is an issue that can be argued until Saten has to chip ice off his sidewalk. An emotional issue that brings out the ugliness in some folks. I am pro-life for many reasons, my stance and attack me if you will. Abortion kills, and murder is wrong, exceptions, yes. I will just sit back and let the authorities on the subject voice their opinions, I am not one.11:15 PM

What if my conscience opposes the war in Iraq or Afghanistan? Can I stop paying my taxes? What if my conscience opposes idiots like Terry Boose? Can I stop paying his salary? If you're going to make a bad decision, Mr. Boose, at least provide an intelligent explanation as to why you did so or you just look like a blind, know nothing partisan who will do whatever the party leaders tell him to do. this is a giant step back wards.. sadly these people that are against abortions are doing the babies a favor.. the reality is, just as in the days before abortion was legalized, this opens the door for "coat hanger" massacres, and back woods "doctors" trying to treat people whom they are not qualified to see.. you do not want your tax money going for abortion, I get that, but how much of your tax money will now go into trying to save the lives of these women who are forced to do what is necessary without the proper tools, sanitary conditions and knowledge, to protect the mother.If a child could be self sustaining and self sufficient from the moment that it was illegal to abort them, fine, the reality is they need someone to raise them and love them and put in a lot of time.. obviously the mother who wants to abort them does not want to do that.How many horror stories of kids in cages, or eating wallpaper, or chained to a toilet do we have to see before we realize that there are many things worse than abortion..living without love or being loved , is the far worse condition in my opinion.08:32 PM

I tend to view this as a states rights issue. Put it before the voters as a referendum. If you don't like the outcome - move to where the law matches your sentiments. Or, if you need services and your state doesn’t allow for it, go to one that provides it. This nation was originally designed to allow for fifty experiments in govt., not one-size-fits all.*******Also, I wish the Repubs would get OH's fiscal house in order before they start tackling the social issues - first things first.07:03 AM
