Man gets 8 years in prison for hauling marijuana

A Toledo man was sentenced this morning to a mandatory eight-year prison term for helping ship 160 pounds of marijuana from Phoenix to Huron County in the fall. Earlier this month, a Huron County Common Pleas Court jury found John E. Nunley Jr., 35, guilty of possession of marijuana for the Sept. 20 incident. Several officers involved in the investigation had testified Nunley drove his father's 2002 black Chevrolet pickup truck to pick up four crates of marijuana from R & L Transfer. Authorities from several agencies arrested Nunley and two suspected accomplices on U.S. 250 north of Milan after following the two vehicles from the rural Norwalk business.

A Toledo man was sentenced this morning to a mandatory eight-year prison term for helping ship 160 pounds of marijuana from Phoenix to Huron County in the fall.

Earlier this month, a Huron County Common Pleas Court jury found John E. Nunley Jr., 35, guilty of possession of marijuana for the Sept. 20 incident. Several officers involved in the investigation had testified Nunley drove his father's 2002 black Chevrolet pickup truck to pick up four crates of marijuana from R & L Transfer. Authorities from several agencies arrested Nunley and two suspected accomplices on U.S. 250 north of Milan after following the two vehicles from the rural Norwalk business.

Judge James Conway fined Nunley $7,500 and credited the truck, worth about the same amount, toward the fine. The vehicle will be forfeited to the state.

Defense attorney James VanDeilen asked the judge to release Nunley on an appeal bond. Conway denied the request, saying: "The court is not aware of any apparent errors in the proceeding," referring to the trial. The judge later declined to elaborate on the strength of an appeal.

VanDeilen, after today's hearing, said there was "no doubt" Nunley drove the truck, but said is his defense was if his client knowingly possessed or controlled the drugs. The attorney said he planned to appeal as soon as he learned about 100 of the 160 pounds of the same marijuana was "taken from the sheriff."

Suspects broke into a Shady Lane Drive storage area the morning of April 30 by prying open the main door. Nunley, his attorney, court staff and the jurors had been to the barn the previous day to see how the marijuana had been packaged before the trial started.

Huron County Prosecutor Russell Leffler has said it was "a heck of a circumstance" Nunley was at the jury view before the theft. He also said he has "a sneaking suspicion it's not some stranger on the street."

VanDeilen said his client has denied being involved.

"As far as I know, the prosecutor considers him a suspect. That's the absolute worst thing that could have happened him for that stuff to come up missing," he said.

Nunley's co-defendants in the Sept. 20 offense, Marcos M. Jaso, 35, and Carlos Torres Jr., 31, both of Toledo, are scheduled to go to trial in July.

I have a strong sneaking suspicion this is a cover up of an inside job. Looks like some prosecutors and law enforcement officials will go to any length to get a conviction. Why would they care, it's just more brownie points for them. Sad that it's at the expense of a human being losing 8 years of his life. Isn't it time that Huron County voters consider a new prosecutor and new sheriff? Someone who is honest and fair?

you are putting him in the same classification as L. Ron Hubbard, the Pope, Mother Teresa, Oprah, etc.. and i am not sure that someone who tries to bring in 160 pounds of pot, so he can get rich off of your kids, and mine, is even in the same column that you have created!!!

it is time to come up with a different class for these types of people.. the Jeffery Dahmers, Oswald, Manson, Snoop Dog, Shug Nite, etc.. and throw this guy in that new category.... thats where he needs to be...
it's one thing to be caught with a little stash, for your own personal use, but if you have 160 pounds , that is way over the limit!!! he is obviously a criminal, and should be treated as such

Swiss Family, pot is pot. Nine tons or as you put it "little stash, for your own personal use," is still the same illegal substance. And yes, Nunley is a human being just like you and me. Perhaps you should read the Holy Bible so you wouldn't be so self righteous. If you had ever broke one law in your lifetime then you are a criminal too. Nunley didn't murder people like Dahmer, Manson, Oswald and the others did, so look at your own stretch. I'm not a bleeding heart liberal and yes, a court of law found him guilty. Bar owners, Carry-out owners, or anyone who sells alcohol to a minor should also go to prison for eight years. Kids aren't the only ones who smoke pot. Baby boomers in their fifties and sixties smoke pot. Where do you think they get it from? The magic pot fairy? Perhaps the Huron County law enforcement officials should go to prison for stashing the pot near a high school because a person caught selling pot near a school receive much stiffer penalties. My point is, murderers, pedophiles, rapists, and other criminals who commit crimes where there are direct victims often get much lighter sentences. I suggest you examine your own heart and pray for Nunley. That's exactly what the Pope would tell you.

unfortunately, there is a big difference possessing a small amount of pot, for your own recreation, it is a misdemeanor.. and having tons of pot, which is a felony!! and if you don't know the difference between those two. then you are beyond help!!!

How I see it

this is just a guy trying to make a dishonest buck off something that shouldn't be dishonest in the first place. From the sounds of the posters in here the only thing your kids have to worry about is you getting into their stash. You people must be high from the comments you make here. To lump this guy in with the worlds worst criminals is nuts. You should be lumping your government in with these people. He's not selling pot to your kids, he's selling to the hypocrite, baby boomer parents of the kids that can't afford pot, that's why they do heroine. Heroine's dirt cheap, pot's not. The so called War on Drugs is killing our kids. Billions of dollars that could be paying down the debt and helping the helpless is being pi$$ed away on the biggest self promotional scam in the history of scams. You'll never hear a politician say this but I'll guarantee they all agree. What's good for the people is one thing but what's good for the pockets of the politicians, insurance companies and the lawyers is something else.

Charles Wireman, a Greenwich sex offender gets 2 years in prison.
I think the Wireman should have received 8 years in prison and Nunley should have received, at the most, 2 years in prison. How is it that sex offenders receive less time in prison than someone who hauls pot in a pick up truck? There is definitely something wrong with our justice system.
To: How I see it, thank you for the well thought out comment! In my opinion, one of the best comments so far. By the way, isn't R & L transfer in Erie County anyways? I wonder how this case ended up being heard in Huron County. I sure hope that Nunley's attorney files an appeal. It will be interesting to see how little time the heroin addicts who stole thousands of dollars from the elderly couple get sentenced to prison.

The "War" on drugs is making a huge profit for a lot of people so it will continue. They don't go after the "big guys" because that might slow it down some. If they legalize pot the "right people" might be out of a job or have a reduction of income. Won't ever happen. The fact that our kids are dying from heroin doesn't matter to the government at all.

How I see it

is the government really thinks that people really think they are really fighting the War on Drugs. We can't legally go into other countries to eradicate their drug production. The drug lords are more powerful than the governments of most of these countries. So we send money to them and the money ends up in the pockets of a corrupt government and then into the pockets of the drug lords. Throwing money at problems has to stop. It never works and will never work. Just like welfare, if pay people to be poor you're going to have a lot of poor people. We can put them out of business, stop a lot of violent crime, save a lot of kids lives and pay off our national debt but no politician will ever admit it. That would be political suicide. Gun crimes alone would drop immensely. Legalization isn't the answer, legitimization is. Manufacture, distribute and control.

I am his sister and he is a genuine human being YES A HUMAN BEING in fact a very intelligent, hard working HUMAN BEING and all you have to say is the worst about him!! Get off the negitive bandwagon and have some compassion for the wrongful sentance that was given to him. You know what ...what comes around goes around!!! I agree with you Heather as it being a wrongful sentence, epecially when child molesters get much less time in prison. I don't smoke pot but I would rather see pot legalized and alcohol made illegal. Too many inocent people have been killed by people driving while intoxicated from alcohol. Alcohol impairs a person far more than marijuans does. Too many family's are destroyed by alcholism. Also, there are people sitting in prison for crack cocaine sentences that are being released early. Which in my opinion is way off base. And as far as Swiss Family, he/she comments on many articles with an attitude that she can walk on water.

No mention of finding the missing 100 pounds of moldy pot, but the remaining 60 pounds will be kept as evidence. With after all that pot has been through don't you think it would be considered as evidence that has been tampered with?

to "tea sea en" i think that you are watching too much tv!!!.. they caught this guy red handed, driving with all of the pot in his vehicle.. so they have all the facts that they need to make this stick.. it doesn't really matter at this point if someone else's fingerprints are on the pot or not... if they caught the guy red handed, and they still have 60 pounds of the illegal pot that he was caught hauling in, he is going away for a good long time...

i feel very strongly that the law needs crack down on rapest and murders less on drug offenders why does a child rapest only get two years where a non violent drug offender get eight years where the justice in that free Mr. Nunley
