Heroin defendant to be kicked off probation after jail term

A Norwalk man who went to a locked-down treatment facility was sentenced Wednesday to serve six months in jail for violating his probation.

Shaun M. O'Donnell, 29, of 141 Milan Ave., had a medical discharge from a community-based corrections facility, a form of prison which focuses on substance abuse treatment and education. However, Huron County Assistant Prosecutor Daivia Kasper said the defendant stopped checking in with his probation officer and "picked up a couple misdemeanors" in another county.

"He had already done over months (in jail)," Kasper said.

After O'Donnell serves the remaining two months, he will be unsuccessfully kicked off probation.

His underlying conviction is possession of heroin.

In late February 2013, O'Donnell pleaded guilty to having a half-gram of heroin during an Aug. 2, 2012 traffic stop. Norwalk police handled the stop when O'Donnell was driving without a license.

Huron County Common Pleas Judge Jim Conway, during a late July hearing, told O'Donnell his "test run here was horrible" on bond for how he might do on probation. The judge was referring to the defendant being intoxicated and found passed out on the sidewalk the day of his original sentencing hearing.

"(O'Donnell) was found face-planted in the parking lot of Rite Aid. ... The caller saw him do a face-plant," Kasper said at the time.

"He did say he was going to court. ... He said 'a lot' a couple times," she added, referring to how much O'Donnell had to drink.

Huron County Public Defender David Longo explained the circumstances. O'Donnell had been prescribed Vicodin for an arm surgery a few days earlier.

"He didn't just go on a bender," Longo said.

"Unfortunately, later that day his grandmother died. They were close. He did some drinking that night," said the public defender, who noted the alcohol in O'Donnell's system interacted with the Vicodin.

"It wasn't intentional. ... He didn't just get smashed for the hell of it," Longo said.
