Woman, 29, accused of having sex with boy

Victim was between the ages of 13 and 15; prosecutor from Ohio Attorney General’s Office assisted in indictment against Gallipolis woman.

A Gallia County woman is facing a multiple-count indictment following her alleged sexual misconduct with a juvenile last year.

Autumn L. Alban-Beaver, 29, of Gallipolis, pleaded not guilty to five counts of unlawful sexual conduct with a minor, all felonies of the third degree; one count of the illegal use of a minor in nudity-oriented material or performance, a felony of the fifth degree; and one count of disseminating matter harmful to juveniles, a misdemeanor of the first degree.

According to the indictment, filed and signed by special prosecutor Angela Canepa of the Ohio Attorney General’s Office, between June 1, 2013, and Aug. 31, 2013, Beaver allegedly engaged in sexual intercourse with the victim — only identified as “R.T.” — who was 13 years of age, but less than 16 years of age at the time of the incidents, as well as possessed or viewed material that shows “R.T.” and disseminated to the juvenile, “R.T.,” material that is harmful to juveniles.

During Thursday’s hearing, Alban-Beaver appeared with her retained counsel, K. Robert Toy, of Athens, while Canepa appeared representing the state of Ohio.

The defendant’s bond was set at $75,000, own recognizance, with an additional bond of $1,500, 10 percent.

As a condition of her bond, the defendant was ordered to have no contact with the person or the property of the victim, R.T., and must attend any pre-trial settlement conference.

Alban-Beaver is scheduled to appear for a status conference June 13. A negotiated plea agreement may be filed with the Gallia County Clerk of Courts office by July 25. A jury trial has been scheduled for Aug. 26.

Following the arraignment hearing, bond was posted for Alban-Beaver’s release from the Gallia County Jail.

As outlined in the Ohio Revised Code, the defendant could face up to 60 months, or five years of imprisonment, for each charge of unlawful sexual conduct with a minor. The charge of illegal use of a minor in nudity-oriented material or performance could result in a prison term of six to 12 months, and the defendant could serve up to 180 days in jail for the the misdemeanor charge of disseminating matter harmful to juveniles.
