Man denies involvement in suspected heroin transaction, turns down plea bargain.

Defendant Dylan T.K. Mundy got cold feet at the last second about pleading guilty Wednesday.

"I had nothing to do with the drug transaction. I was ordering food while she was doing what she was doing," the 23-year-old Norwalk resident said.

Huron County Prosecutor Russell Leffler had offered to have Mundy plead guilty to one count of trafficking in heroin in connection with a July 30, 2012 incident. In exchange, the state was willing to eliminate the vehicle specification, which meant the defendant could have forfeited a 1996 Honda Accord alleged to be used in the suspected transaction.

Also, Leffler said he was willing to dismiss a second trafficking-in-heroin charge in connection with a July 31, 2013 incident and from another case, one count of possession of heroin stemming from an Aug. 17, 2013 offense not far from Pleasant Elementary School (pictured above, click HERE for more details.)

"The state, at the time of sentencing, will recommend a community-based corrections facility," Leffler told the court.

Leffler said the Huron County Sheriff's Office had information that Mundy and a female suspect were willing to drive from Berlin Heights to Norwalk to sell heroin.

The suspected transaction happened July 30, 2012 at the McDonald's in the northside of Norwalk.

The confidential informant said the female suspect handed her two balloons of heroin and she handed $40 to Mundy, Leffler said at Tuesday's hearing.

Mundy disagreed with the prosecutor's statement of the suspected facts in the case. Huron County Common Pleas Judge Jim Conway ordered a recess so Mundy could talk to his defense attorney, Curtis Koch.

"At this point, he does not wish to plead (guilty) and requests the consolidation of trial dates," Koch later told the judge.

The court consolidated the cases and scheduled a Jan. 28 further, final pre-trial hearing and a Feb. 4 trial date.

Mundy, after conferring with Koch, talked about his case with a female defendant sitting in the same row with him in the courtroom.

"When he read that off, I said, 'I'm not pleading to that," Mundy told her. "I didn't sell any drugs. I can't plead to something I didn't do. I'll take it to trial."

Mundy received a six-months prison term in April 2012 for selling heroin after telling Conway he'd rather go to prison than spend time in locked-down substance abuse treatment facility. A weapon was seized from him during that heroin investigation, which led to another charge because Mundy was convicted of marijuana trafficking in 2009, meaning he wasn't allowed to have a firearm in his possession. Mundy agreed to forfeit the handgun and $526 in cash.

Mundy also was in the news in April 2012 after a pair of teens broke into his motel room and beat him with a large bolt.
