NL man gets help

After seeking help about 20 times in the last two months, Fredrick Biller is finally getting the help he needs, said New London Police Chief Mike Marko.

On Monday, Biller left his home three times before being transported by Firelands Ambulance to Fisher-Titus Medical Center (FTMC) "because he wanted to hurt himself," Marko said.

First, Biller sought out police. Second, Biller left home to seek a family friend. Then, after dark, Biller left his family's West Washburn home and went into a downtown business and told someone there he was going to hurt himself, Marko said.

The concerned citizen at the business called police, who in turn called for a squad after talking to the 42-year-old mentally disabled man.

Biller was transported to a mental facility from FTMC for care, where he remained yesterday, Marko said.

After trying to get help for the family for months, Marko said he's "actually glad. I think he'll (Biller) get the help he needs now."

The evaluators at the hospital "see there is an obvious problem... I think it's great," Marko said.

I'm glad he's getting help, but I don't think plastering his mental illness on the Internet/newspaper is helping him either.

I don't know the police chief but from following this story.... it seems to me he is a good man and has been trying to get this guy and his family for months... he has went out of his way and above his job description. I am sure it has been discouraging and frustrating at times. I hope the community follows his example and helps this man and his family out.. it is Christmas time... good work chief and you seem to be a remarkable example of of a city servant

It's kind of a trade off. My guess is it was the only way for them to get help. They didn't ask for it but you can't deny they needed it. I wonder if they even have heat yet.

Why does the police chief think its necessary and appropriate to disclose this man's name and mental health issues!! I would think this would be a HIPAA violation!!!

Who said the Police Chief released that info? Its common knowlage in New London im guessing. The Kidd guy was interviewed and the family was interviewed.

The police chief should not of disclosed this info and the Norwalk reflector should not of printed this article!!!! It's absolutely ridiculous naming a person and giving their mental health background when they obviously need or want help!! I don't know how many articles I read where a criminal has been charged with a crime but isn't named. I think it's more important to know the background and names of the criminals in the community rather than a persons medical history and background!!

How would this section apply to either the Chief or the media, Federal law always trump State law.

All these folks citing different laws w/ regard to mental disabilities do not live in or around New London. The Billers mental state / Life style are well known to locals. We all knew this family would implode one day. Luckily no one has been injured so far. Freddie has made derisive comments to me just walking out of a business. He tries to "hug" any unsuspecting woman. As I understand he is banned from the Dollar store due to his unwelcome "Hugs" Anyone who has tried to help them wind up in some ordeal w/ them. Helen is downright hateful. Agree they need help but due to the privacy codes etc. it has become impossible to help anyone without govt intervention(and we know how that goes) Our Police Cheif has shown great patience in dealing w/ these folks. I place blame squarly on their case worker (she probably finds them too difficult)

I'm actually thankful this man is getting help. I'm not afraid to publically stand up for myself. He got ruled incompetant years ago after sexually assaulting girls in New London. I know this for fact and would be willing to go public with it. The case got dropped because my mother was friends with the family. He didn't have to suffer. I had to suffer my whole life while this guy got to go free and live in a free society where he couldn't even function. 5 year olds can't defend themselves. yet my whole life I had to suffer in silence. I'm glad someone is finally helping him. Honestly problem his need to probably want to hurt himself is the guilt he's suffering all these years from the girls he hurt. I know this comment will probably get me banned the world deserves to know the truth behind his mental incompetence and he should not be allowed back in the public.

I hope to properly address each comment regarding this article appropriately. Let me start by saying that public safety personnel respond to calls regarding mental health regularly. The Police Chief in no way went above his service classification by responding to this man’s call for service. This is his job. I find it disturbing that people would think it is ok to plaster one’s mental health in the paper, but keep the names of those who used CSX money to overdose on heroin private.

This article made no mention of a family receiving help for heat or indicated anyone being interviewed other than the Police Chief himself. Chief Marko clearly reported this person’s statements of wanting to hurt himself. The article, NL family’s plight sparks county commissioner’s interest, in no way referenced names of those involved. In fact, the name was withheld due to privacy laws. In all fairness to those who are not from NL, we would not have knowledge of everything or everyone involved. I have simply address this article in whole.

Cracked, an appropriate name, there is no reason to resort to name calling. Generally if you have nothing intelligent to say, the bully comes out. Empty trash cans make the most noise. The chief may have saved this man’s life, but does not give him the right to plaster his name and mental issues in the paper. That is like the EMS responding to give you CPR because you forgot to breathe. They save your life and the paper reports that you are such an idiot you forgot to breath. That, although quite accurate, is not appropriate.

Now the Rest of…, The Hipaa law is far more detailed than what you posted. Federal law does not always trump state law. It’s called the “Home Rule”. However, some federal laws do trump state law if it is expressive in the law. Hipaa is expressive in saying it supersedes state law, unless said state law is more strict is it governing. In the case of mental health, Ohio law supersedes federal. Here is an example you may understand. DEA doesn’t recognize medical marijuana and sees no medicinal qualities. Therefore, by federal law, possession, sales, use and cultivation is unlawful. However, some states have legalized the use of medical marijuana…..”Home Rule”

Toast, regardless of the person’s history, annoyance in town and common knowledge in the area in which they reside, does not give anyone the right to plaster a person’s mental health in the paper. I feel the Chief of police not only violated Ohio law, but subjected the village and himself to a lawsuit.

I am glad Freddie is in the hospital, and getting treatment! What happens when he is released? The home still has no heat, and his family Mother and Brother are still living in less than basic housing needs. Yes, Freddie probably needs a special needs home to live in, like Flat Rock, or ARC, but how will that happen unless his custody is changed? The other family members still need help maybe a guardian for all of the family who can not or will not care for themselves.

well let me say this .. there really isn't help for the mentally ill, I can remember another new London family that had problems with a son, and we went with them to dhr and they asked for help because they were not able to handle him, they were turned away, and threatened that they would be in trouble for abuse, neglect and abondement for leaving him up there, so we all went back to new London, it finally took drastic measures to get this family the help that they needed

I was a nurse for 44 years, I am familiar with HIPPA.
I am sorry you feel the way you do, whiile sarcastic perhaps I did not attack anyone. I will leave that to those whose talents are better in that area.

For your information I do work in the medical profession!!
What does it matter if it's initiated be law enforcement, EMS or first responders? The fact is people are bound to the privacy act, which is part of HIPAA!! This not only includes medical records but all medical info, mental illness or drug abuse history.
If you were or are a nurse for 44 years I would think you would at least know how to spell HIPAA!!!
By the way I don't know you and thank god for that!! I try not to associate myself with ignorance!!

Hipaa law would prevent saying what their diagnosis is or what medication they are on or like their social security number is. It does not prevent saying the names of an individual or age or if they have a mental disability. Not sure where all of those so called rules people are coming up with are coming from. For example child with mental disability gets heart warming gift bet you have all seen those types of things before. 90% of the people on here feel they are a lawyer get a life do research before you post and remember federal laws super cede ohio law. Hipaa is trying to make it to where it would be against the law to state if they have a metal disability however at this time it is not and they are having trouble getting that to take effect.

My point is, there are HIPAA laws to protect individuals from discrimination. The LE is NOT a medical doctor who can diagnose and disclose to the public about his medical well being. The LE also was gratifying in the fact that FTMC observed an obvious problem. Even the doctors wouldn't come out and say it was a mental condition.

You must not know the facts or live in new london. Also just because the doctors wouldn't say doesn't mean it becomes illegal then. Ever heard of company policy? That is probably their policy to give minimal information. Just because that would be their policy doesn't make it illegal to give out information that is not covered by Hipaa like this story for example. Also do a check on who is required to abide by Hipaa law. LE aren't required nor are you and me.

In today's day and age everybody is sue happy attorneys will try for anything so will lots of other people. It's a way of them minimizing the amount of lawsuits that they're probably dealing with all the time anyways due to it being a hospital. One of the most common lawsuits is medical malpractice which are typically false and either trying to just get a quick buck off a settlement instead of going to court. I'm sure they don't want to deal more false lawsuits. This is a way to minimize it there is no way to minimize the medical malpractice suits

The question arose about the hospital not disclosing the mans diagnosis. It wasn't about medical malpractice, or negligence.
I agree, they are avoiding (at least taking precautions) for a lawsuit releasing the mans medical history/diagnosis.
