Woman sues ex-fiance, wants her Chevy pickup back

A Dayton woman is suing her former fiance because she says he used her to get financing for a Chevy pickup truck he couldn’t obtain because of bad credit.

After the engagement ended, Erin Maggard claims the payments came due on the pickup and the credit union came after her instead of Centerville’s Richard Thomas III.

The civil lawsuit filed in Montgomery County Common Pleas Court indicates the couple were engaged in May 2012 when Thomas allegedly induced Maggard into incurring a loan for more than $24,000 for a 2012 Chevrolet Colorado.

Maggard said Thomas couldn’t get financing on his own because of low credit scores, but that he said he would make payments. By Oct. 19, 2012, Thomas “unjustifiably terminated the engagement” with Maggard but kept the Colorado.

The suit alleges Thomas didn’t make payments and Maggard was called by the credit union who issued the loan regarding lack of payment. Maggard said she asked for the vehicle to be issued in her name only, and, despite promises by Thomas to do so, he did not turn over the paperwork and avoided her.

The pickup was repossessed, causing Thomas to make payments to regain possession of the Colorado. Maggard alleges the vehicle incurred collision damage while in Thomas’ possession and that the damage remains because insurance was not maintained.

The suit said Thomas has been “unjustly enriched” by obtaining the title without incurring any financial obligation and that has damaged Maggard, who wants the truck and paperwork to show she’s the owner

The other charge listed is fraud, with Maggard saying Thomas induced her into financing the loan on his behalf “knowing that he was not going to maintain or pursue a marital relationship.”

Maggard is seeking damages in excess of $25,000 and attorney fees. Thomas, who has no attorney of record listed in court records, hasn’t yet answered the suit.

When you co-sign for someone, the responsibility comes back on you when that person doesn't hold up their end of the deal. This is a bad judgement call, not a lawsuit. Get real lady.

I bet her friends warned her and she didn't want to listen, and somehow they ended up the bad guys. I have an old friend who consistently dates jail birds and can't figure out why she keeps getting screwed over. Hopefully one day she figures out she doesn't need a man to survive and if anything, wises up and quits falling prey.
