Local man shoots at dog, owner

70-year-old suspect charged with felonious assault in dispute over neighbor's defecating dog.

Frustration over a neighbor's dog defecating in his yard led to the homeowner reportedly shooting at the pet and its owner Wednesday.

Nobody was injured in the Ohio 4 incident near Bellevue reported to the Huron County Sheriff's Office about 11:50 a.m.

The suspect, John A. Mahl, 70, of 6199 Seel Road, Bellevue, was charged with felonious assault. He was released Thursday from the Huron County Jail after posting 10 percent of a $30,000 bond.

"She (the complainant) had let her dog out to use the bathroom," Chief Deputy Ted Patrick said.

"She observed the neighbor come around the corner of his house with a shotgun and (Mahl) fired a shot in the direction of her dog and her. Neither one was hit," Patrick said.

Sgt. Tod Wagner responded to the scene. He confiscated a 12-gauge, single-shot Harrington & Richardson shotgun and a spent shotgun shell cartridge.

"He interviewed Mr. Mahl. ... He indicated to Sgt. Tod Wagner (he shot) in the air," Patrick said.

When Patrick was asked if the suspect provided a reason for firing the gun, Mahl reportedly said "the dog had been defecating in his yard several times."

If convicted, Mahl faces two to eight years in prison.

This seems to me that property own can not defend to property. Let your pet poop in YOUR yard. I know this man he's not pathetic just don't like other dog poop in his yard. Grateful, can I bring my dog over and poop in your yard?

If your dog was in need of a place to relieve itself yes you can, your dog can even play with mine....I would never in my life draw a weapon on someone over that.


Honestly its not like you people know me but you would instantly label me a gun nut or something of the sorts, AND DO NOT GET ME WRONG I condone any self defense of any type especially on our prevlent drug addcits. I am a woman and proud of it. Also have a CCW permit and have hunted all my life. I'm not saying to shoot someone if their pet keeps pooping in your yard. But this gets old after awhile. I have the same problem with the neighbor's dog. How do you recommend I solve this problem? Talking to them didn't work. We live the country so their is plenty of room to poop in their yard, we both have 5 acres of yard. Talked to dog warden about it when he was here to pick up the dead dog on the road. And that didn't help I'm open for suggestions.

Yeah I feel for ya, and wish I could help more. Obviously your a smart womman and i would think it safe to say we both know it is not the dogs fault but the blame is with the owners.


I would complain to the law enforcement available until they get annoyed enough to make the unruly pet owners comply.


I just hope you agree a defenseless animal, pooping in a yard doesnt deserve to be executed, the pets owners on the other hand well I can only imagine they are as upstanding as many of the Norwalk scum people.

maybe you need to pick it up, save it in a gallon pail, then when you have about half of the pail full, mix it with water, take it over and dump it on their porch. If their dog can come on your property and poop, then I am sure they won't mind if you return the favor.

I don't agree with shooting your weapon off, but I like wasp71's idea.
I get really fed up with other peoples animals wandering into my yard to crap.
I have four big dogs I keep inside my house, with an outside fenced in area to do their business. I do my part as a pet owner. When I walk my dogs,I carry plenty of plastic bags. So do your part or else.

Neither neighbor had respect for the other one. The one allowing for the dog to poop in the other's yard should be charged with trespassing or improper disposal of a hazerdous waste. In the case of Maryland v. Linda May Johnson, the lady letting her dog use the restroom in the nieghbors yard was charged by the state for this. I know of cases where people have been charged with improper waste disposal for letting their dogs do this. The bottom line is that it is very rude and the lady letting her dog do this will be taught nothing by this.

The hilljacks that live about 1/4 mile down the road from Mr. Mahl have been letting their dog(s) run about his, and others' property, for several years. Mr. Mahl has tried, in vain, to get the dog warden and sheriff to do their jobs, but to no avail. I suggested that he leave a little something "sweet" out for the mutts so that they could quench the powerful thirst that often times follows a powerful dump in the neighbor's yard.

I guess that Mr. Mahl decided to fire a volley to show those loser dog owners that he meant business. He's a good enough shot, that IF, he were aiming at the mutt, it would be dead. Likewise, the swank owner of same.
