A convicted rapist turned down a plea deal Wednesday and has a bench trial scheduled on two sex charges.
Former Norwalk resident Norvell T. McIntire, 45, of Sandusky, will have two counts of importuning tried June 26 before Huron County Common Pleas Judge Jim Conway. The two fifth-degree felonies, each of which are punishable by six to 12 months in prison, are in connection with an Aug. 25 incident.
"(The attorneys) have not been able to reach an agreement at this time," Conway said.
Huron County Assistant Prosecutor Jennifer DeLand is representing the state while McIntire's attorney is Huron County Public Defender David Longo.
"The bench trial should take more than half (of) a day, from my conversation with counsel," Conway said Wednesday.
McIntire is accused of approaching two 14-year-old girls about having sex, Norwalk police said. The girls were riding their bicycles on Cline Street at the time, but were able to get away from the suspect.
"He actually hugged them," Detective Sgt. Jim Fulton said soon afterward.
In early May, a jury deliberated for almost four hours before finding McIntire guilty of four sex-related felonies and public indecency, a second-degree misdemeanor. He was convicted of rape, gross sexual imposition, attempted gross sexual imposition and importuning for crimes that happened within about a week of each other in August. Both of McIntire's accusers testified.
The 14-year-old girl was upstairs with McIntire when nobody else was home. DeLand said when the victim walked away from McIntire, he grabbed her arm, pushed her onto a couch and fondled the girl as he held her down.
"He told her, 'You like it.' He told her, 'Don't tell anybody," DeLand told jurors.
In the other incident at the same house, the 11-year-old girl was sitting on a couch with McIntire.
The victim testified the man untied and pulled open his gym shorts and tried to get her to look at his private parts. The girl said she flexed her arm and pulled away when McIntire grabbed her arm and tried to get her to touch his penis. She then left the couch, had two of her friends come to the bathroom with her and she told them what happened.
Before the incidents, McIntire approached both girls, who are best friends, and asked them if he could touch their butts.
"We said no and walked away. When we walked away, he smacked our butts ... with his palm," the younger girl said.
McIntire is being held without bond at the Huron County Jail until he is sentenced June 27.
