Rape charge filed against man already facing other sex charges

A former Norwalk man facing a pending sex-related charge has been secretly indicted on two similar and more serious felonies.

Norvell T. McIntire, 44, now of Sandusky, appeared Tuesday morning for his arraignment in Huron County Common Pleas Court. He is charged with one count each of rape and gross sexual imposition. A grand jury indicted McIntire after meeting Friday. The indictment wasn't made public until after his arrest and court hearing.

"We knew these charges would be added," Huron County Public Defender David Longo told Judge Jim Conway. "He agreed to wait for (these) upcoming charges."

In the pending case, McIntire is charged with importuning in connection with soliciting two 14-year-old local girls for sex Aug. 25. His trial on all three felonies is scheduled for March 12.

Norwalk Police Officer Paul Gardner arrested McIntire just before 3 p.m. Monday on Benedict Avenue. He then was transported to the Huron County Jail. The suspect had been out on a $40,000 bond.

Huron County Assistant Prosecutor Jennifer DeLand talked briefly about the new felonies after Monday's hearing.

"This is separate from the other case. While these charges are similar, it is a different (female) victim," she said.

If convicted of rape, McIntire faces three to 11 years in prison and would be classified as a Tier III sex offender. That classification would require him to register his address for the rest of his life.

A conviction on gross sexual imposition is punishable by six to 18 months behind bars. The two felonies cover incidents involving the same girl.

In the importuning case, McIntire faces six to 12 months.

On Aug. 25, two girls were riding their bicycles on Cline Street when McIntire reportedly approached them about having sex, police said.

"They wanted to get away from him. He actually hugged them," Detective Sgt. Jim Fulton said soon afterward. "They got away from him."

Soon after McIntire was arrested, another young girl shared another sex-related allegation with Fulton. The detective said the girl alleged McIntire sexually assaulted another 12-year-old girl at a Grove Avenue apartment -- one of two places in Norwalk where he had lived.

Since 2000, Norwalk police have compiled 10 to 15 reports in which McIntire was accused of committing sexual offenses.

"He's been doing this for years," Fulton said. "He was banned from the rec center in 2003 because he was following a girl."

In 2000, McIntire was accused of exposing himself to a girl, but she couldn't positively identify him. Also, between 2003 and 2005, there was a rape allegation reported about McIntire, but he wasn't indicted.

McIntire now must post a $20,000 bond before being released from jail. He is prohibited from having any association or communication with anyone under the age of 18.
