WEB EXCLUSIVE - Norwalk man gets prison time for probation violations

A Norwalk man was sentenced Monday to 17 months in prison for violating the terms of his probation on three separate convictions.

Donald G. Miller, 27, of 1475 High St., admitted to testing positive twice for drugs, once for opiates and a second time for opiates and cocaine, Huron County Assistant Prosecutor Daivia Kasper said. He also stopped attending substance abuse counseling at Firelands Counseling & Recovery Services and failed to report to his probation officer as of February.

"He had failed to report four times in the complaint," Kasper added. "He was on community control on all three cases."

Miller's underlying convictions were attempted tampering with evidence, possession of drugs and trafficking in drugs.

In May 2006, he served 120 days in the Huron County Jail with work-release privileges for a drug screen incident in which a probation officer found Miller with a vial of urine he intended to use and then had Miller provide his own urine sample.

Kasper said Miller served 90 days in jail for another probation violation at the same time he was sentenced for the urine tampering offense. In 2005, he successfully completed time in a prison which focuses on education and substance abuse treatment before he violated his probation, she explained.

In other court news:

Eddie D. Tackett, 39, of 101 First St., Willard, was sentenced Friday to 11 months in prison for selling cocaine twice to the same confidential informant on Oct. 12 and Jan. 14, Assistant Prosecutor Dina Shenker said.

During the hearing, he pleaded guilty to two counts of trafficking in cocaine in exchange for the state dismissing two charges of trafficking in heroin.

"He wanted to waive his presentence investigation and be sentenced on the spot," Shenker said.

The court also ordered Tackett to pay $355 in restitution to METRICH Drug Task Force and the Willard Police Department.
